The regular meeting of the City of Scotland was called to order by Mayor Curtis Hofer at 5:00pm on Monday, August 9, 2021. The following council members answered to roll call Randy Abbink, Tim Asche, Jerry Nelson, Dennis Bietz, and Randy Thum. Those council members absent were Sean Barrett. Others present were Finance Officer Tanya Bult, City Maintenance Chris Simantel, City Attorney Kent Lehr, Peggy Schelske, Ray Beecher, Kirk Breisch, and Richard Petzoldt.

A motion was made by Asche, second by Bietz to approve the agenda. All voted in favor. Motion carried.

A motion was made by Abbink, second by Nelson to approve the minutes of the July 12th regular meeting. All voted in favor. Motion carried.

A motion was made by Bietz, second by Nelson to approve the bills. All voted in favor. Motion carried.

Finance Officer’s Report - In July, 23 notices of intent to disconnect service letters were mailed with none being disconnected.

City Maintenance Report - Working on patching streets, getting ready for the rodeo, received approval to get the 2011 Scag that leaks water overhauled, move speed sign to Sixth Street.

Public Concerns:
Kirk Breisch - Spoke against a portion of Williams Street being vacated.
Ray Beecher - Status of code enforcement clean-up efforts.

Bietz - Thanked the Mayor for driving to Bismarck to pick-up new pool pump.
Thum - Park blacktop by basketball hoops is not a parking lot.

Cemetery Update - A motion was made by Bietz, second by Abbink to purchase the columns and caps from Hardscapes Outlet at the cost of $7,791.60 to complete the cemetery fence entrances. All voted in favor. Motion carried.

Fire Pit Ordinance - A motion was made by Abbink, second by Thum to approve ordinance 2021-02, an ordinance adopting fire pit regulations. All voted in favor. Motion carried.

CHAPTER 3.04  -  FIRE PIT REGULATIONS

BE IT ORDAINED BY THE MUNICIPALITY OF SCOTLAND, BON HOMME COUNTY, SOUTH DAKOTA,

Open burning for campfires and outdoor cooking is permitted without any burning permit if performed in an approved container constructed of steel, brick, masonry or fire pit.

Additionally, open burning in portable, outdoor fireplaces is permitted.

Burning that is offensive or objectionable because of smoke or odor omissions or when atmospheric conditions or local circumstances make such fire hazardous shall be prohibited.

Hours of operation. A person shall not maintain any outdoor burning from midnight to 6:00 a.m. unless permitted and approved by the City in advance.

Extinguishment authority. City officials or law enforcement are authorized to order the extinguishment of the fire or burning that creates or adds to a hazardous or objectionable situation.

For clarity, fire pit includes below ground pits, free standing fireplaces as set forth above, and portable devices intended to contain and control outdoor fires. All below fire ground pits shall be at least four inches in depth and shall be surrounded on the outside, above ground, by a noncombustible material such as steel, brick or masonry. The fire pit cannot exceed three feet in diameter, nor may the fire pile exceed two feet in height. No fire pit shall be closer than twelve feet to any building or other combustible material.

Fire pits may be used in accordance with the manufacturer's specifications and these additional regulations. Only natural firewood or untreated lumber (has no paint or varnish) may be burned. No burning of leaves, yard waste, paper, cardboard, garbage and similar items is permitted.

The fire must be constantly attended and supervised until the fire has been completely extinguished. A portable fire extinguisher or other approved extinguishment equipment such as a garden hose must be readily available

If the City deems that the conditions are too dry for any type of outdoor fire, the City may by resolution order a temporary ban on the operation or use of any outdoor fire pit.

Water Meter Update - Letters will be mailed out soon to all residents to schedule a time to have their new water meter installed. First letter asks residents to schedule a time for installation. Two weeks later a second letter warning you are running out of time to schedule an appointment. Two weeks after second letter a third letter disconnection notice to shut off water until new meter is installed. Installation will begin either August 30th or September 7th. A motion was made by Thum, second by Asche to approve a loan with payment coming from the water surcharge. All voted in favor. Motion carried.

2022 Appropriation Ordinance - A motion was made by Bietz, second by Thum to give 1st reading of the budget ordinance #2021-03, an ordinance setting the appropriations for the 2022 budget. All voted in favor. Motion carried.

Audit Findings - A motion was made by Abbink, second by Thum to accept the 2019 & 2020 audit report. All voted in favor. Motion carried.

Bon Homme County Pre-Disaster Mitigation Plan - A motion was made by Bietz, second by Thum to approve the pre-disaster plan resolution. All voted in favor. Motion carried.

RESOLUTION 2021-01

A resolution of the City Council of Scotland declaring its support for, and adoption of, the Bon Homme County Multi-Jurisdiction Pre-Disaster Mitigation Plan.

WHEREAS a Pre-Disaster Mitigation Plan for Bon Homme County (the Plan) has been developed; and

WHEREAS the City of Scotland participated in the development of the Plan; and

WHEREAS the Plan will be used as a disaster mitigation planning tool as deemed appropriate by the Scotland City Council.

NOW THEREFORE BE IT RESOLVED that the Scotland City Council hereby adopts and supports the Plan, and will take action to ensure that the Plan is implemented successfully.

Daily Malt Beverage Permit - Scotland VFW requested a daily malt beverage license for Saturday, August 14 for the Street Dance being held on Main Street. A motion was made by Thum, second by Nelson to approve the Daily Malt Beverage License request. All voted in favor. Motion carried.

Close Third Street - A motion was made by Abbink, second by Asche to allow Third Street to be closed from the alley to Main Street on August 14 for the Vendor Fair being held at the City Hall. All voted in favor. Motion carried.

Set meeting date for the September Meeting - The meeting will be on Monday, September 13, 2021 at 5:00pm.

A motion was made by Thum, second by Nelson to enter into executive session at 5:17pm for Legal as per SDCL 1-25-2 Sub (3). All voted in favor.  Motion carried.

A motion was made by Bietz, second by Abbink to come out of executive session at 5:32pm with no action taken. All voted in favor. Motion carried.

A motion was made by Thum, second by Asche to enter into executive session at 5:32pm for Personnel as per SDCL 1-25-2 Sub (1). All voted in favor.  Motion carried.

A motion was made by Abbink, second by Bietz to come out of executive session at 5:52pm with no action taken. All voted in favor. Motion carried.

With no further business to discuss a motion was made by Bietz, second by Nelson to adjourn the meeting at 5:53pm. All voted in favor. Motion carried.
