The regular meeting of the City of Scotland was called to order by Mayor Randy Thum at 5:01pm on Monday, March 10, 2025. The following council members answered to roll call Randy Abbink, Wayne Bertrand, Myles Runyon, and Dennis Bietz. Those council members absent were Victor Settje and Tim Asche. Others present were Tanya Bult, Domm Pechous, Peggy Schelske and Maggie Spak.

A motion was made by Bietz, second by Bertrand to approve the amended agenda. All voted in favor. Motion carried.

A motion was made by Abbink, second by Runyon to approve the minutes of last month’s regular meeting with the correction of compensation of officers motion, Runyon opposed not abstained the vote. All voted in favor. Motion carried.

A motion was made by Bietz, second by Abbink to approve the bills. All voted in favor. Motion carried.

Finance Officer Report - The city has demonstrated excellence in water system management and maintenance for 23 consecutive years. Victor Settje had shown interest in obtaining the water distribution, wastewater collection and stabilization pond certifications. To be eligible to take the classes and test one must work 24 hours or more a week for a year. A council member can’t exceed $5,000 per year wages.

Police Report - February calls for service: traffic stops (7), agency assist (1), 911 calls (1), information (1), arrest (1), suspicious person (2), warrant service (1). City ordinance enforcement: parking tickets (12), animal control (2).

City Maintenance Report - Domm passed his spraying tests, attended MSHA safety training in Tyndall, Dakota Pump was here working on the Main Street lift station.

Council Concerns/Committee Reports:
Abbink - Is parking allowed on Washington Street for semi’s? Yes, it’s the truck route.
Bertrand - None
Runyon - None
Bietz - A brief update on the cylinder for the grader was given. A replacement cylinder has been located.

City Election - There will be a city election held in the city office meeting room on Tuesday, April 8, 2025 from 7:00am - 7:00pm for Mayor 2-year position, Ward II 2-year position, and Ward III 2-year position.

Compensation of Officers - A motion was made by Runyon, second by Abbink to pass and approve the second reading of the compensation of officers ordinance. All voted in favor. Motion carried.

ORDINANCE NO. 2025-01
AN ORDINANCE AMENDING SECTION 2.0204 OF CHAPTER 2.02, RELATING TO OFFICERS.
BE IT ORDAINED BY THE MUNICIPALITY OF SCOTLAND, BON HOMME COUNTY, SOUTH DAKOTA AS FOLLOWS:

That Section 2.0204 Chapter 2.02 entitled Officers be revised and amended as follows:

2.0204     Compensation of Officers
The officers enumerated below shall receive the salaries in the manner and amount indicated:
Mayor, $400 per monthly attended meeting, and in addition thereto $100 per special meeting.
Aldermen, $200 per monthly attended meeting, and in addition thereto, $100 per special meeting.

Local Board of Equalization - The Local Board of Equalization meeting will be on Monday, March 17, 2025 at 5:30pm. The deadline to file an appeal is Thursday, March 13, 2025 at the finance office by 5pm.

Public Parks, Grounds and Buildings - A motion was made by Bertrand, second by Runyon to pass and approve the second reading of the public parks, grounds, and buildings ordinance. All voted in favor. Motion carried.

TITLE VII     Public Parks, Grounds and Buildings
Chapter 7.01     Parks and Grounds

7.0101     Park Supervisors
The Mayor and the City Council of the City of Scotland shall be and are hereby constituted as the Board of Park Supervisors for the City of Scotland.

7.0102     Defacing Park Properties
Any person who shall deface, mar, injure, break into or in any way interfere with any building or structure, or other property situated in any park belonging to the City of Scotland, shall be guilty of a misdemeanor.

7.0103     Protection of Trees, Shrubs and Flowers
Any person who shall climb any tree, cut, break, pluck, root up, or in any way disturb any trees, flowers, shrubs or other plants whatever, planted or growing in any public park or other public ground without the express authority of the board of Park Supervisors, shall be guilty of a misdemeanor.

7.0104     Rubbish
It shall be unlawful for any person to throw or deposit or cause to be thrown or deposited any paper, tin cans, rubbish or offal of any kind in any such public park or in or about any place set apart for swimming or body of water or stream within or adjoining any park in the City of Scotland and under the control of the Park Supervisors of said city, except in receptacles properly designated as depositories for such refuse or rubbish.

7.0105     Parking
It shall be unlawful for any person to lead or drive any horses or other animals or fowl or any vehicle or motor vehicle over or upon any of the grass plots or planting space of any public park, except at such places as may be provided for the parking of the same.

7.0106     Selling of Merchandise in Park Places
It shall be unlawful for any person to do any peddling or to sell or offer for sale any goods, ware or merchandise in any of the public parks of the City of Scotland, unless such person has been granted written permission for such purpose by the Board of Park Supervisors.

7.0107     Rosehill Cemetery
No graves may be redug or reopened without first notifying and receiving permission to do so from the City Sexton of the City of Scotland, South Dakota.

Only one grave marker will be allowed above the ground per grave.

More than one ground marker will be allowed per grave providing that the ground marker is flush with the ground.

The City Sexton will be notified prior to setting of all markers, whether they be ground markers or markers which protrude above the ground.

Flowers may be set by the graves; however, the flowers shall be in close proximity to the headstone, and in holders provided for that purpose at the grave.

No glass shall be allowed on or near the grave at any time.

No individual shall plant trees, plants, or shrubs on the gravesites.

No individual shall plant trees, plants, or shrubs within the confines of the City Cemetery without the written permission of the City Sexton.

An item not permanently attached to the Memorial Stone needs to be removed from the gravesite with the exception during Memorial Day weekend.  That includes but not limited to the following: all ornaments, shepherd’s hooks, and other hardware that is not permanently attached to the Memorial Stone.

Chapter 7.02     Public Buildings and Property

7.0201     Insurance Required
The City Finance Officer shall, under the direction of the City Council, keep all public property of the city properly protected by insurance to cover such risks as are appropriate, in reliable insurance companies and securely keep such policies of insurance. The Finance Officer shall also advise the City Council at least thirty (30) days before the expiration date of any polices of insurance carried on said public property.

7.0202     Rental of the City Hall
The auditorium of the City Hall and the basement of the City Hall are hereby opened to public use, subject to the following rates and regulations:

No lease for the said auditorium shall be a valid lease which shall lease the same to any person, firm, or corporation for a period of more than five (5) nights per week.

The City Hall basement shall be rented for a twenty-four (24) hour period as follows:

The City Hall basement and City Hall first floor shall be rented free of charge to all public fraternal organizations located within the City of Scotland, once a year at no cost to said organizations.

7.0203     Manager of the City Hall Rentals
The Mayor shall appoint a person to be in charge of the City Hall rentals at the first meeting in May.

7.0204     Duties of the Manager
The manager shall be subject to the rules and regulations herein provided and the order of the City Council or its duly appointed committee. He/she shall let said building only to responsible parties who desire to use the same, and he/she shall receive and collect the rent therefore in advance and credit the same to a separate City Hall fund account and pay over the same to the City Finance Officer, taking his/her receipt for the same.

Election Board - A motion was made by Abbink, second by Bertrand to hire Billie Jo Hays @ $13.50 per hour for the day of the election. All voted in favor. Motion carried.

AirMedCare Membership - Bult presented brochures with pricing to the council.

City Wide Clean-Up - Bon Homme County Restricted Landfill has set the date for the annual spring clean-up with the start date to be Monday, April 21, 2025. All items must be set out by 8am and must be sorted as they go in separate areas at the landfill.

Stafford Street Railroad Crossing - A motion was made by Abbink, second by Runyon to pay the cities half up to $8,000 on the repair of the railroad crossing on Stafford Street. Yay: Abbink, Bertrand, Runyon. Nay: Bietz. Motion carried.

Street Sweeping Contract - A motion was made by Runyon, second by Bietz to enter into contract with the SD DOT for sweeping Highway 25 for 2025. All voted in favor. Motion carried.

Set meeting date for the April Meeting - The meeting will be on Monday, April 7, 2025 at 5pm.

A motion was made by Bertrand, second by Bietz to enter into executive session at 5:24pm for Personnel as per SDCL 1-25-2 Sub (1) Evaluation. All voted in favor.  Motion carried.

A motion was made by Bertrand, second by Runyon to come out of executive session at 6:11pm with the following action taken. All voted in favor. Motion carried.

A motion was made by Bietz, second by Abbink to give the following raise to full time employee Dommonick Pechous to $24.25 per hour following 6-month evaluation. All voted in favor. Motion carried. 

With no further business to discuss a motion was made by Runyon, second by Bertrand to adjourn the meeting at 6:12pm. All voted in favor. Motion carried.
